Terms & Conditions
Anyone reserving, purchasing, or receiving any puppy or dog from Central Valley German Shepherds or boarding a puppy or dog at Central Valley German Shepherds, hereby acknowledges they have read, understand, and accept the terms, conditions and policies contained herein.
Definitions
- Dog
- For the purpose of this document, refers to a canine of any age, including puppies and adult dogs, regardless of ownership, breed, gender, etc.
- Date of Availability
- The date when ownership of a Dog is ready to be transferred from Central Valley German Shepherds to its new owner. For puppies this usually occurs once the puppy is 8 weeks of age, weighs at least 4.5kg (10 lbs), has been vaccinated at least once, and is fully weaned from its mother, unless otherwise specified. Medical conditions, health issues, pending test results, pending procedures, travel plans and/or travel delays, and/or veterinarian clearance, etc. may affect the date of availability of a Dog. As of 2005, CA PENAL CODE § 597z states that it is a misdemeanor for any person to sell a dog under eight weeks of age, unless, prior to any physical transfer of the dog from the seller to the purchaser, the dog is approved for sale, as evidenced by written documentation from a veterinarian licensed to practice in California. For this reason, no Dog will be sold prior to becoming 8 weeks old, weighing 4.5kg, and having been vaccinated at least once.
- Boarded Dog
- Any Dog that is being housed, sheltered, fed, monitored, treated, or otherwise cared for by Central Valley German Shepherds on a temporary basis. This includes but is not limited to puppies or dogs owned by anyone other than Central Valley German Shepherds, puppies owned by Central Valley German Shepherds, who are 5 or more days past their Date of availability and have been reserved by a Prospective Owner.
- Reserved
- A Dog for which a Prospective Owner has paid a deposit to have the Dog held specifically for them to purchase, thereby making the Dog unavailable to for anyone else to purchase. By reserving a Dog, the Prospective Owner agrees to purchase the Dog at its full asking price in addition to any applicable fees.
- Prospective Owner
- Any person, who intends to pay the full asking price of a Dog plus any applicable fees, has made a non-refundable deposit on that Dog in order to Reserve the Dog, and then claims the Dog within 10 days of the Dog's Date of availability.
Reserving a Puppy/Dog
Reserving a Dog requires a deposit of $250 per Dog. The deposit is non-refundable. The purpose of reserving a Dog is to make that Dog unavailable to be reserved or purchased by any other Prospective Owner. By reserving a Dog, the Prospective Owner who reserves the Dog is agreeing to pay the full asking price for that Dog, plus any applicable fees, and to claim the Dog within 5 days from the Date of availability for that Dog. Reservations and deposits are non-transferrable unless you are requesting to reserve a Dog from an upcoming litter, before that litter is born. If you choose to reserve a Dog from an upcoming litter, you have the option of selecting either a male or female Dog, depending upon availability at the time of birth. If you choose to reserve a specific gender of Dog from an upcoming litter, and that litter does not contain that gender of dog, then you have the option of selecting another gender Dog, or using your reservation deposit for a different litter. You may also choose to reserve the right to "Pick of the litter" for an upcoming litter. By reserving the right to Pick of the Litter, you will have first choice for the Dog of your choosing once the litter is born. When choosing Pick of the litter, you MUST choose the Dog you would like to reserve within 7 days of the date of birth of the litter.
Reservation Deposits
Any/all reservation deposits are NON-REFUNDABLE. By placing a reservation deposit for a Dog, you are agreeing to pay the full asking price of that Dog once the Dog reaches the Date of availability. By reserving a Dog, you are thereby making that Dog unavailable to be reserved by other Prospective Owners. Reserving a Dog DOES NOT automatically transfer ownership of the Dog to any other party. In order to transfer ownership of the Dog, the Prospective Owner must reserve the Dog, pay the full asking price for the Dog plus any applicable fees, and claim the Dog within 10 days of the Dog's Date of availability. Once all these conditions of the sale are met, the ownership of the Dog will be transferred from Central Valley German Shepherds to the new owner.
Claiming Your Puppy/Dog
Any/all Dogs purchased or Reserved from Central Valley German Shepherds, MUST be claimed within 5 days of their Date of availability. Any Dog that is not claimed within 5 days of its Date of availability, will be considered a Boarded Dog and will be subject to Central Valley German Shepherds daily dog boarding fees of $100/per dog/per day. Any boarding fees MUST be paid before any Boarded Dog can be claimed by its owner, or ownership transferred away from Central Valley German Shepherds.
Abandoned Dogs
Any Dog not claimed by its owner within 10 days of its Date of availability, will be considered Abandoned by the Dog's owner. For Reserved Dogs owned by Central Valley German Shepherds, an Abandoned Dog will remain the sole property of Central Valley German Shepherds, any deposit funds received for that Dog will be retained by Central Valley German Shepherds and used by Central Valley German Shepherds to cover board and care costs for that Dog at Central Valley German Shepherds' regular boarding rate of $100 per dog, per day. ANY Abandoned Dog will become the sole property of Central Valley German Shepherds, and any other owner(s) will release all claims of ownership of, or interest in the Dog to Central Valley German Shepherds.
Returning a Dog
Should the need arise for a new owner to return a Dog for any reason, it is at Central Valley German Shepherds' discretion whether or not the Dog may be returned. Each return will be handled on a case-by-case basis. If/When a Dog is returned and accepted, Central Valley German Shepherds will therefore need to board and care for that Dog until the Dog can be successfully placed in a new home. Due to the costs associated with board and care of the Dog, NO REFUNDS will be issued for returned Dogs, NO EXCEPTIONS to this policy will be made.
To preserve the integrity of our kennels and the health of our other animals, returns of Dogs who are ill, possibly ill, have not been fully vaccinated, have parasitic or pest infestation, or are injured, altered, or are in any condition other than that condition they were in when ownership of that Dog was transferred, will NOT be accepted. NO EXCEPTIONS.
AKC Registration
Every Dog sold by Central Valley German Shepherds includes an AKC registration application to allow the new owner of that Dog to register the Dog with the AKC. There two types of AKC registration, the two types are LIMITED and UNLIMITED. The difference between these two types of registration is whether or not the Dog being registered can be used to produce AKC registerable litters. A Dog with a limited registration is not intended to be used for the purpose of breeding, therefor the AKC will not recognize any litters derived from that Dog as AKC registerable. This is not to say that the Dogs are not purebred, or AKC registered, it simply means that any offspring will not be registerable by the AKC.
Typically, all Dogs Central Valley German Shepherds sells include limited AKC registration. In the event that a Prospective Owner would like to breed the Dog he/she purchases from Central Valley German Shepherds, then it is up to that Prospective Owner to request an unlimited registration application for the Dog they purchase from Central Valley German Shepherds. Upon request, prior to the Prospective Owner claiming their Dog, Central Valley German Shepherds shall provide an AKC registration form for unlimited registration for that Dog. Once a Dogs is claimed by a Prospective Owner, the registration status of that Dog cannot be changed unless the new owner of the Dog makes a written request to the AKC and Central Valley German Shepherds, to have the Dog's registration status changed. Any Dog registration status changes will be subject to a $500 unlimited re-registration fee for that Dog, in addition to AKC service fees.
Credit/Debit/Venmo Payments
Any payments made to Central Valley German Shepherds via credit card, debit card, Venmo, or any other online payment processing service will be subject to a 4.5% processing fee. This fee is to cover surcharges from these payment processing services. Cash payments will not be subject to these additional fees, therefor we recommend making cash or Zelle payments whenever possible.
